It has been announced that after much consultation the small Claims limit of £1000.00 for personal injury claims is to remain.
It had been proposed that the small claims limit could be increased to £5000.00 which would have included a large number of personal injury claims that come before the Court. This could potentially have deprived many Claimants, having claims valued up to £5000.00, of Legal Representation due to the cost limit associated with small claims hearings.
The Lord Chancellor has stated that raising the claims threshold “would be a reform which does not have the consumer at its heart”.
There is to be further consultation within the profession and other parties as to ways in which the claims process in personal injury cases can be made more efficient.
