We have recently acted for a client who sustained a traumatic injury to his right hand thumb when in the course of his employment he severed the top half of his thumb on a circular saw. The employer was convicted of offences under the Health & Safety Act and fined £15,000.00. Civil proceedings were taken for the recovery of damages which included compensation for pain and suffering and loss of amenity as a result of the amputation, past and future loss of earnings. The claim was settled five days before commencement of the trial due to take place at Telford County Court when the Defendant consented to a Judgement in the sum of £97,500.00. |
